StayWaale is a platform that provides villas, bungalows, homestays, farmhouses, apartments and/or their individual rooms to guests mainly for residential/vacation purposes, under the brand name “StayWaale”. The below Terms & Conditions are applicable to all guests/customers who book any property (defined below) or individual rooms through our website, mobile application, partner websites, travel agents, advertisements, or any referral channels (collectively “Booking Channels”). Guests must carefully read and understand all Terms & Conditions before making a booking through any of the Booking Channels. If you are not agreeable to these Terms, please do not proceed with booking. StayWaale reserves the right to amend these Terms at any time without prior notice, and the updated terms will be effective immediately upon posting on our website. For clarity, the following definitions apply: (a) “Property/Properties” – Includes villas, bungalows, farmhouses, homestays, apartments, service residences and/or their rooms available for booking on StayWaale. (b) “Guest/Guests” – Any individual, company, or entity who books a property through any Booking Channel. (c) “Booking” – A confirmed reservation made by a Guest for a Property via StayWaale. (d) “Check-In” – The scheduled date and time when Guests are permitted to occupy the booked Property after completing required formalities. (e) “Check-Out” – The scheduled date and time when Guests must vacate the booked Property after completing all check-out formalities. (f) “Booking Period” – The duration between the Check-In date and the Check-Out date. (g) “Booking Amount” – The total price payable by the Guest for the confirmed stay at the Property, inclusive of applicable fees and taxes. (h) “Booking Confirmation” – The email/communication shared by StayWaale confirming the booking after receipt of the Booking Amount, containing details of Guests, Property, dates, terms, and charges. (i) “Advance” – A non-refundable deposit required at the time of booking to hold a reservation. (j) “Security Deposit” – An amount (if applicable) collected from Guests to cover damages, breakages, or violations of house rules. Refund of this deposit is subject to post-checkout inspection. (k) “Peak Days” – Specific high-demand dates such as long weekends, festivals, Diwali, Christmas, New Year, or other holidays defined by StayWaale.
Your use of this website is subject to these Terms & Conditions of Use along with the Privacy Policy and any other policies published on StayWaale’s website. These Terms form a binding agreement between you and StayWaale with respect to the use of this website and the services offered. By accessing, browsing, viewing, storing, or otherwise using our website, applications, or services, or by completing a booking, you acknowledge that you have read, understood, and agreed to all the terms and conditions (including the Privacy Policy) and agree to be legally bound by them. The website, its content, infrastructure, and the vacation rental booking services provided through this platform (the “Services”) are owned, operated, and provided by StayWaale and are intended solely for your personal, non-commercial use, subject to these Terms & Conditions.
Use of our Booking Channels for making a reservation in respect of any Property is available only to persons who are legally capable of entering into binding contracts under the provisions of the Indian Contract Act, 1872. Individuals who are classified as ‘incompetent to contract’ under the Act, including but not limited to minors, persons of unsound mind, or those disqualified from contracting by any applicable law, are not eligible to use our Booking Channels for making a Booking. By using our website or completing a booking, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms & Conditions.
StayWaale grants you a non-exclusive, non-transferable, limited license to access and view the pages of this website on your personal computer or device for the purpose of browsing properties and making bookings. Failure to comply with these Terms & Conditions will result in the automatic termination of the rights granted to you without prior notice. Except for the limited rights mentioned herein, StayWaale does not grant you any express or implied rights or licenses under any patents, trademarks, copyrights, or other intellectual property rights. You agree that: • You will not copy, reproduce, modify, distribute, display, or create derivative works from any content of this website without StayWaale’s prior written consent. • You will not use any device, software, or routine to interfere or attempt to interfere with the proper functioning of this website or any booking transaction conducted on it. • You will not introduce any viruses, trojan horses, worms, malware, time bombs, bots, or other harmful code intended to disrupt or damage systems, data, or information. Any unauthorized use of the website’s content, infrastructure, or booking system is strictly prohibited and may result in legal action.
StayWaale serves as an online platform for browsing and booking properties such as villas, bungalows, homestays, apartments, and farmhouses at competitive prices. StayWaale may also publish content about the Properties, including descriptions, images, and amenities, as provided by the Hosts. The inclusion of any specific amenities or services in a property listing does not guarantee their availability at all times. StayWaale reserves the right to update, modify, or discontinue any amenity, service, or feature without prior notice. StayWaale does not provide or supply any music, entertainment systems, or audio services at the Properties. If a Guest wishes to host an event, gathering, or celebration at a Property, StayWaale may assist in coordinating with the Host and guiding on necessary permissions or compliances. However, it remains the Guest’s responsibility to obtain all statutory approvals, pay applicable charges, and comply with local laws for hosting such events.
All property details, descriptions, photos, amenities, and availability information are provided by the Hosts. While StayWaale makes reasonable efforts to verify the accuracy of this information, it cannot guarantee that all content is complete, error-free, or up to date. Guests are encouraged to verify details with the Host before confirming a booking. StayWaale shall not be held liable for any inaccuracies, misrepresentations, or omissions in property content.
Some properties may provide additional services such as meals, guided tours, transport, or recreational activities. These are offered by the Hosts or third-party providers, not StayWaale. StayWaale does not guarantee availability, quality, or safety of such services, and any charges for these services will be payable directly by the Guest to the Host or service provider.
All prices displayed on StayWaale are set by the Hosts and may vary depending on the property, season, or booking duration. • Prices may be shown inclusive or exclusive of taxes, depending on applicable laws. • Guests are responsible for paying the full booking amount (including service fees and taxes, if applicable) as displayed at checkout. • Prices are subject to change until the booking is confirmed.
Hosts and StayWaale reserve the right to refuse entry to any Guest who fails to: • Provide valid government-issued identification at Check-In. • Comply with property rules or local laws. • Engage in respectful behavior with Hosts, staff, or neighbors. Guests may be evicted without refund for misconduct, illegal activities, or damage to the property.
• Guest Service Fee: StayWaale may charge a service fee per booking, displayed at checkout. This is non-refundable. • Host Commission Fee: StayWaale deducts a commission from the Host payout for each booking. • Taxes: Applicable GST or other statutory taxes may apply to bookings and will be charged as per government regulations.
Guests agree to use the property solely for lawful vacation or residential purposes. Activities such as parties, subletting, or commercial use are not permitted unless explicitly authorized by the Host. Guests are responsible for maintaining property condition and adhering to house rules. Any violation may result in eviction and forfeiture of the Security Deposit.
StayWaale’s platform may contain links to third-party websites for convenience (such as payment gateways or partner services). StayWaale does not control or endorse such websites and is not responsible for their content, policies, or practices.
StayWaale may provide promotional codes, discounts, or special offers from time to time. These offers: • Are valid only for the period specified. • Cannot be combined with other discounts unless mentioned. • May be withdrawn or modified at any time without prior notice.
• A booking is considered valid only when the Guest pays the required Advance or Security Deposit (as applicable). • By making such payment, the Guest confirms that they have read and unconditionally accepted all booking details and StayWaale’s Terms & Conditions. • A Booking Confirmation email/notification may be issued upon receipt of payment. However, StayWaale shall not be liable to serve the booking unless the entire booking amount is received within the specified due dates. • In case of bookings made through third-party websites, travel agents, or advertisements, Guests must verify their booking with StayWaale directly. StayWaale’s Terms & Conditions shall prevail over any inconsistent third-party terms.
In certain cases, a booking may be placed “On Hold” when the Guest pays only an Advance amount. The booking will be confirmed only after full payment within the timeline specified. Failure to complete the payment may result in automatic cancellation without refund of the Advance.
• Check-In and Check-Out times are as specified in the Booking Confirmation. • Guests are advised not to arrive before the scheduled Check-In time. Early arrival may attract additional charges. • Guests must vacate the property at the specified Check-Out time. Late Check-Out without prior approval may result in extra charges. • Any approved change in timings must be confirmed in writing by StayWaale.
• Guests must pay the Advance prior to Booking Confirmation. Without this, no booking will be held. • Guests are required to inspect the property within 90 minutes of Check-In and report any damages. Failure to do so will make the Guest liable for all damages identified later. • Guests must handle the property, appliances, furniture, and fittings with care. • If an item forming part of a set is damaged (e.g., one glass from a set of six), the Guest may be liable to replace the entire set. • Security Deposit refunds (after deducting applicable charges) will be processed within 30 days of Check-Out. • If damages exceed the Security Deposit, the Guest must pay the additional amount within 7 days of notification.
StayWaale accepts payments via: • Credit/Debit Cards – Visa, MasterCard, RuPay, American Express, etc. • Net Banking / UPI / Wallets – As supported by payment gateways. • Any charges levied by banks or payment gateways are independent of StayWaale. If payment is not received in full, StayWaale is not obliged to honor the booking.
By providing financial information (credit/debit card, UPI, etc.), the Guest confirms that such details are valid and lawfully owned. StayWaale will not be liable for fraudulent use of financial details. Guests are solely responsible for the security of their payment information.
• Each property’s pet policy will be specified in the Booking Confirmation. • Pets may only be brought with prior written approval. Unauthorized pets may result in eviction without refund. • Guests are responsible for ensuring pets do not damage the property or disturb neighbors. • Additional non-refundable pet fees or cleaning charges may apply.
Any violation of StayWaale’s Terms, house rules, or applicable laws may result in: • Cancellation of booking without refund. • Forfeiture of Security Deposit. • Blacklisting of the Guest from future bookings.
• StayWaale reserves the right to cancel bookings at any time without prior notice. • Guests must refer to the Cancellation Policy page for the latest rules applicable to their booking. • Service fees or convenience charges (if any) are non-refundable.
• Guests must respect the residential nature of properties and avoid disturbing neighbors. • Loud music or disruptive activities in outdoor/common areas are strictly prohibited. • Properties may only be used for lawful residential/vacation purposes. Illegal, immoral, or commercial use is forbidden. • Use of prohibited substances, organizing rave parties, or possession of weapons/explosives will result in eviction and may lead to police action.
StayWaale is committed to protecting Guest data in line with: • Information Technology Act, 2000 and amendments. • IT (Intermediary Guidelines) Rules, 2011. • IT (Reasonable Security Practices and Procedures and Sensitive Personal Data) Rules, 2011. Data collected through online and offline booking channels will be stored securely and used only for booking, service, and compliance purposes, as per our Privacy Policy.
StayWaale respects your privacy. Any personal data collected during booking (online or offline) will be stored securely and used strictly in accordance with our Privacy Policy. We comply with: i. Information Technology Act, 2000 (as amended). ii. Information Technology (Intermediary Guidelines) Rules, 2011. iii. Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. All data shared by Guests through our booking channels will be treated as confidential, except where disclosure is required by law.
Unless stated otherwise, all content, software, images, logos, trademarks, service marks, domain names, and material available on our Booking Channels are the exclusive property of StayWaale. You may not copy, reproduce, link, distribute, market, or exploit our content without prior written permission. Any unauthorized use will be treated as infringement of StayWaale’s Intellectual Property Rights and may invite legal action.
StayWaale is a booking platform and shall not be liable for: a) Accidents, injuries, fires, hazards, or deaths occurring at the property. b) Illegal or hazardous activities committed by Guests or their visitors. c) Criminal acts such as harassment, theft, violence, drug use, or immoral activities. d) Structural issues such as cracks, seepage, leakage, malfunctioning electronics, or swimming pool problems. All damages must be reported before Check-Out. Claims raised later will not be entertained. If StayWaale is found liable in exceptional cases, our liability shall be limited to the Booking Amount paid by the Guest.
• Property descriptions and images are provided as realistically as possible. StayWaale is not liable for minor discrepancies in size, décor, or presentation. • Guests must report any major issues (e.g., non-functional amenities, lack of cleanliness, insect infestation, or odor) within 12 hours of Check-In via email/phone/WhatsApp, along with evidence. StayWaale will attempt to resolve issues but is not obligated to provide refunds if resolution is delayed or not possible. • If a property is double-booked or unavailable at Check-In, StayWaale will make reasonable efforts to arrange alternative accommodation of comparable size and quality.
StayWaale shall not be held liable for cancellations, delays, or losses arising from events beyond its reasonable control (“Force Majeure Events”), including but not limited to natural disasters, pandemics, government restrictions, strikes, riots, civil unrest, fire, flood, or technical breakdowns.
StayWaale reserves the right to terminate or suspend a Guest’s account or access to our website/booking channels without prior notice, if there is any violation of these Terms, Privacy Policy, or unlawful behavior. In such cases, StayWaale may also delete or deactivate your account immediately.
• Any disputes, claims, or differences related to bookings shall first be resolved amicably. • If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed mutually. • Arbitration shall be conducted in English, seated in Mumbai, India. • Subject to arbitration, the courts in Mumbai shall have exclusive jurisdiction.
Guests may not assign or transfer their rights under these Terms without StayWaale’s prior consent. StayWaale may assign its rights and obligations at its discretion.
All official communication will be sent to the email address provided during booking. Guests must ensure their contact details are accurate and up to date.
By making a booking, you confirm that it is strictly for personal, private, or residential use and not for commercial or unauthorized purposes. You expressly agree to indemnify, defend, and hold harmless StayWaale, its affiliates, contractors, employees, officers, and agents from and against any losses, damages, liabilities, claims, or expenses (including legal fees) arising out of: • Breach of the assurance that the booking is for residential use only. • Misuse of StayWaale’s services or booking channels. • Violation of these Terms & Conditions. • Any false representation, warranty, or covenant made by the Guest. This indemnification includes but is not limited to claims for loss of income, damage to property, reputational harm, or any indirect or consequential damages.
Guests may submit reviews, feedback, or suggestions. By doing so, you grant StayWaale a non-exclusive license to use, display, or publish such content on its platform.
Failure of StayWaale to enforce any provision of these Terms shall not constitute a waiver of that provision or right.

Any feedback, suggestions, ideas, concepts, reviews, photos, or other material (“Submissions”) shared by Guests with StayWaale shall become the exclusive property of StayWaale. By submitting, you grant StayWaale the right to use, publish, reproduce, or modify such content for any purpose (commercial or otherwise) without compensation. You further agree that: • Your Submissions shall not infringe any third-party rights. • You will be solely responsible for any harm, damage, or claims arising out of your Submissions. • StayWaale shall not be held liable for any misuse or violation caused by your Submissions.
• These Terms constitute the entire agreement between Guests and StayWaale. • If any provision is found invalid, the remaining provisions shall continue in full force. • StayWaale reserves the right to update these Terms at any time. Continued use of the website implies acceptance of updated Terms.
